RETAIL · CBD & VAPE SHOPS
The rules change monthly. A missed ID check is a Class A misdemeanor. Your staff needs more than a generic employee handbook — they need documented procedures that reflect current Texas law.

Why CBD & Vape Retail Is Different
Most Texas vape and CBD shops are running on a generic retail handbook — or nothing at all. That's a liability your competitors haven't fixed either. The shop that documents these four areas first is the one that survives an inspection or a TWC complaint.
Texas requires 21+ for hemp, CBD, and vape products. A single underage sale is a Class A misdemeanor. Your staff need a written SOP — who checks, what IDs qualify, what to do when someone pushes back. The Texas 18+ military-ID exception applies to tobacco and nicotine only — not hemp or CBD — and we document it to current Texas law.
SB 2024 banned cannabinoid vapes in Texas — Delta-8, Delta-10, THCA, HHC vapes are off the table. Smokable hemp and THCA are subject to evolving DSHS rulemaking. Your authorized product list acknowledgment needs to reflect current law, and employees need to sign a new version each time it changes.
A standard zero-tolerance drug policy doesn't work in a hemp shop. Employees handle hemp products daily — incidental exposure is real. Your policy needs hemp-aware language that addresses on-the-job handling, off-duty legal use, and impairment vs. presence standards. A downloaded template won't have this.
Banking restrictions keep many hemp retailers cash-heavy. Without a written cash handling policy — opening/closing counts, drop-safe procedures, dual control — you're exposed to both theft and liability. If something goes missing and you didn't document the procedure, the TWC investigation starts with your records.
